Do you know, the 2019 National Youth Tobacco Survey states that 27.5 percent of high school students in the U.S. claim to use e-cigarettes, also known as vaping. This figure was more than twice the 11.7 percent which was recorded just two years before. To prevent the world from this kind of situation, we executed the Children’s Act.
The president of the United States, Mr. Donald Trump, signed this act into law in the year 2020. In the vaping industry, this act is commonly known as the “vape mail ban.” This act mentions a minimum age of 18 years in many states to buy or use vaping products. The intent was to prevent underage smoking and online sales of e-cigarettes to children.
You can also call this act “The Jenkins Act.” It was executed in March 2021. The PACT Act enabled restrictions on the delivery of cigarettes or vaping products to consumers. The intent was to prevent illegal tobacco and vape products sales and tax avoidance. It also restricts these products from being shipped via the United States Postal Service.
Failing to abide by the rules and regulations implemented by the PACT Act can raise the possibility of heavy penalties of $5,000 to $10,000 for each violation.
You can consider electronic nicotine delivery systems, commonly known as ENDS, as the devices such as vape pens or tanks, electronic cigarettes, vaporizers, and e-pipes, among many others. All of these vape devices are non-combustible tobacco products. Due to this act, the FDA now monitors the import, export, advertising, sale, packaging, labeling, distribution, and production of all these products.
It also controls the parts and components of ENDS products, except for all accessories. Here are some examples of such features-
FDA implemented it in the year 2016.
If your company produces, modifies, fabricates, mixes, fixes, assembles, repacks, labels, or imports ENDS products, then the FDA considers you a tobacco product “manufacture.” Therefore, you will have to get your company registered and submit the list of products, advertisements, and labeling. Besides this, you’ll also need to submit other details like an ingredient listing and data.
The U.S. House of Representatives sanctioned this act in February 2020. The name of this bill was the Protective American Lungs and Reversing the Youth Epidemic Act of 2020. The intent was to tackle the youth tobacco crisis. This act bans most flavored tobacco and vaping products, which contain mint and menthol flavor. Apart from affecting vaping companies, it also imposes taxes on nicotine e-cigarettes.
So, these were the five most essential laws which can have a massive impact on your vaping company. Violation of these laws may have devastating consequences. We strictly recommend the proper enforcement of the laws in your company. Thus, they should be obeyed and followed efficiently.
